These Terms & Conditions ("Terms") govern your access to and use of the KiddoSleep website, products, and services ("Services").

By accessing our website, placing an order, or using our Services, you agree to these Terms.

By using this website or purchasing any product, you confirm that:

All Products are subject to availability.

If payment has already been received for a cancelled order, the applicable amount will be refunded.

13. Returns & Refunds

Returns, exchanges, cancellations, and refunds are governed by our Return & Refund Policy, which forms part of these Terms.

By placing an order, you acknowledge that you have read and accepted our Return & Refund Policy.

Nothing in these Terms limits any mandatory consumer rights that cannot be excluded under applicable law.

KiddoSleep cannot guarantee that every Product will be suitable for every child, body type, preference, or individual circumstance.

If you are uncertain whether a Product is appropriate for your child, consult an appropriately qualified healthcare or childcare professional before use.

15. Product Safety & User Responsibilities

The safe use of KiddoSleep Products depends upon following the applicable product instructions, selecting the appropriate size, proper use, regular inspection, and responsible supervision.

By purchasing or using a Product, the customer acknowledges and agrees that:

  • The Product must be used in accordance with the applicable product instructions.

  • The appropriate size must be selected based on the applicable sizing information.

  • The Product must not be used if any component appears damaged, excessively worn, or otherwise unsafe.

  • The Product must not be modified or altered in a manner inconsistent with its intended use.

  • The Product must only be used within its published specifications and intended use.

  • Parents, guardians, or caregivers are responsible for supervising children when required by the product instructions.

  • Improper use, misuse, or use outside the intended specifications may increase the risk of discomfort, injury, or property damage.

  • Users must immediately stop using the Product if it becomes damaged, defective, or otherwise appears unsafe until it has been properly inspected or replaced.

KiddoSleep Products are not medical devices and are not intended to diagnose, treat, cure, or prevent any medical condition unless expressly stated otherwise.

16. Warranty

KiddoSleep may provide a limited warranty covering manufacturing defects for the period stated in our applicable Warranty Policy.

The warranty does not apply to damage resulting from:

  • Improper use

  • Misuse

  • Abuse

  • Accidents

  • Normal wear and tear

  • Failure to inspect or maintain the Product

  • Unauthorized modifications or repairs

  • Use outside the intended specifications

  • Use of non-approved accessories

  • Improper storage

  • Damage caused by washing or care contrary to the applicable instructions

  • Failure to follow product instructions

The Warranty Policy forms part of these Terms.

17. Limitation of Liability

To the fullest extent permitted by applicable law:

  • KiddoSleep shall not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including loss of profits, business interruption, loss of use, or other economic losses arising from the use of the Services or Products.

  • Our total aggregate liability arising out of or relating to any purchase or use of a Product shall not exceed the purchase price actually paid for the Product giving rise to the claim.

  • Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law, including mandatory consumer protection or product liability laws.

To the extent permitted by law, KiddoSleep is not responsible for their acts, omissions, or policies.

Your personal information is collected, processed, and stored in accordance with our Privacy Policy, which forms part of these Terms.

By using the Services, you acknowledge that your information may be processed as described in our Privacy Policy.

21. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Hong Kong Special Administrative Region, without regard to conflict of law principles.

Nothing in these Terms limits any mandatory consumer rights available under the laws applicable to your place of residence where such rights cannot lawfully be excluded.

22. Force Majeure

KiddoSleep shall not be liable for any delay or failure to perform its obligations resulting from events beyond our reasonable control, including but not limited to:

  • Natural disasters

  • Pandemics

  • Labor disputes

  • Governmental actions

  • War

  • Terrorism

  • Cyberattacks

  • Transportation disruptions

  • Utility failures

  • Supplier disruptions

  • Carrier delays

23. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions shall continue in full force and effect.

24. Stop Use Immediately

The Product must immediately be removed from use if any component becomes:

  • Loose

  • Detached

  • Missing

  • Damaged

  • Torn

  • Deformed

  • Otherwise abnormal or unsafe

The Product must not be used again until it has been properly inspected and it has been determined that continued use is appropriate.

25. Product Use & Safety

Use of KiddoSleep Products does not eliminate the need for appropriate parental or caregiver supervision and responsible use.

Customers are responsible for using the Product in accordance with the applicable product instructions, safety information, product specifications, and applicable laws and regulations.

Customers are also responsible for ensuring that the Product is appropriate for the intended child and is used according to the applicable age, size, and safety requirements.

To the fullest extent permitted by applicable law, KiddoSleep shall not be liable for injury or property damage to the extent arising from improper use, misuse, modification, failure to follow safety instructions, use outside stated specifications, or circumstances beyond KiddoSleep's reasonable control, except to the extent liability cannot legally be excluded or limited under applicable law.

26. Entire Agreement

These Terms, together with our Privacy Policy, Return & Refund Policy, Shipping Policy, Warranty Policy, and any other policies expressly incorporated by reference, constitute the entire agreement between you and Hyperloop E Limited concerning the Services and supersede all prior communications or understandings relating to the same subject matter.
